FLORIDA’S NEW CONSTRUCTION DEFECT STATUTE:

When you buy that fixer-upper and begin making repairs, knowledge of what to do when a contractor or his subcontractor does a bad repair job occurs is crucial to saving big bucks.

First, you must provide the contractor 60 days to fix it before you file suit.

Second, the contractor must within 10 days forward notice to the contractor believed to cause the defect.

Third, within five business days, the contractor can inspect.

Fourth, within 25 days after inspection, the contractor can serve written responses or repair, compromise or deny.

Fifth and Final, then the claimant can accept the offer to repair, or accept payment in compromise and forego litigation. This process has a lot of weaves and turns.
